Terms of Service

Poseidon Academy mobile app

Effective date: September 25, 2026

These Terms govern the Poseidon Academy mobile app (app id com.poseidonholdings.academy, the "App"), provided by Poseidon Holdings ("we," "us," or "our"). They do not cover the theposeidonholdings.com website, which has its own terms and conditions.

1. Acceptance

By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App. You must be at least 13 years old, or the minimum age of digital consent in your country, to create an account. If you are under 18, you should have a parent or guardian's permission.

2. What the App is — and is not

The App provides educational content about the music business: lessons, a glossary, checklists, and Q&A. This content is general information for independent artists.

It is not legal, financial, tax, or professional advice. Contracts, royalties, splits, taxes, and business structures depend on your specific situation and jurisdiction. Always consult a qualified attorney, accountant, or other professional before making decisions. We are not responsible for decisions you make based on App content. Lessons may link to third-party resources such as videos or articles; we do not control and are not responsible for third-party content.

3. Advertising

The App is free and is supported by advertising. Ads are served by a third-party provider, Google AdMob, and are selected by Google rather than by us. We do not review, endorse, or vouch for the products, services, or advertisers shown, and we are not a party to any dealing between you and an advertiser. What data is collected to serve those ads, and how to turn off personalised advertising, is set out in our Privacy Policy.

4. Accounts

  • You must provide a valid email address and keep your password confidential. You are responsible for activity under your account.
  • Passwords must meet our minimum policy: at least 8 characters, including an uppercase letter and a symbol.
  • Notify us at conundrumnation@theposeidonholdings.com if you suspect unauthorized use of your account.
  • You may stop using the App at any time and may request account deletion — see the Privacy Policy.

5. Acceptable use

You agree not to:

  • attempt to gain unauthorized access to the App, its servers, or other users' accounts;
  • probe, scrape, overload, or disrupt the App or its content API;
  • reverse engineer the App except where the law expressly permits it;
  • use the App for anything unlawful;
  • resell, republish, or redistribute App content except as allowed in Section 6.

6. Intellectual property

The App, its design, and all content in it — lessons, glossary, checklists, Q&A, graphics, the trident mark, and the "Poseidon" branding — are owned by Poseidon Holdings or its licensors and are protected by copyright and trademark law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App and its content for your own learning. You may not copy, republish, or commercially exploit the content without our written permission. Third-party open-source software in the App is used under its own licenses, as set out in the app's license notices.

7. Content changes and availability

Content is delivered from our servers and may be added, changed, or removed at any time. The App caches content for offline use, but we do not guarantee that the App or the content service will be uninterrupted, error-free, or available in perpetuity. We may modify or discontinue the App, or features of it, at any time.

8. Termination

We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the App. You may delete your account at any time. Sections 2, 6, 9, 10, and 11 survive termination.

9. Disclaimer of warranties

THE APP AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSEIDON HOLDINGS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR OPPORTUNITIES, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE PAST 12 MONTHS (CURRENTLY $0 — THE APP IS FREE) AND US $50. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

11. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Disputes relating to the App will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction and venue. Nothing here limits mandatory consumer-protection rights in your country of residence.

12. App store terms

If you downloaded the App from the Apple App Store or Google Play, that store's own terms also apply. Apple and Google are not parties to these Terms, have no obligation to provide support or maintenance for the App, and are third-party beneficiaries of these Terms to the extent their store agreements require.

13. Changes to these Terms

We may update these Terms. We will post the new version at theposeidonholdings.com/poseidon-academy/terms and update the effective date above. Continued use after changes take effect means you accept them.
